सुप्रीम कोर्ट ने आज राज्य सरकारों को ये अधिकार दे दिया कि वे आरक्षण के पहले से निर्धारित प्रतिशत में वर्गीकरण कर सकते हैं। यानी शीर्ष अदालत ने कोटे के अंदर कोटा को मान्य करार दिया है। अनुसूचित जाति को मिलने वाले 15 फीसदी आरक्षण में सब-कोटे को सुप्रीम कोर्ट ने गुरुवार को मंजूरी दी है। सुनवाई के दौरान जस्टिस पंकज मिथल ने कहा कि किसी भी कैटिगरी में पहली पीढ़ी को ही आरक्षण मिलना चाहिए। इसके साथ ही उन्होंने कहा कि एससी और एसटी में आरक्षण का वर्गीकरण करना उचित विचार है।
बता दें कि सीजेआई जस्टिस चंद्रचूढ़ की अगुआई में 7 जजों की संवैधानिक पीठ ने आज 6-1 के बहुमत से एक फैसला दिया है कि राज्यों में नौकरियों में SC/ST आरक्षण कोटा में उप वर्गीकरण किया जा सकता है। यानी कि अनुसूचित जाति/जनजाति के भीतर में जो अधिक कमजोर हैं, उनके लिए आरक्षण के भीतर आरक्षण दिया जा सकता है। यह एक तरह से OBC में जो आरक्षण का वर्गीकरण है और OBC आरक्षण में जो क्रीमीलेयर की व्यवस्था है, उसी तरह की व्यवस्था SC/ST के आरक्षण के भीतर लागू करने का निर्णय सुप्रीम कोर्ट की संवैधानिक पीठ ने दिया है। दिलचस्प है कि इस फैसले के पक्ष में जिन 6 जजों ने निर्णय दिया है। उनमें से एक जस्टिस बीआर गवई खुद दलित समुदाय से आने वाले हैं।
जस्टिस बीआर गवई ने राज्य सरकारों से आह्वाहन करते हुए कहा है कि SC/ST में से क्रीमीलेयर की पहचान कर उनकी जगह अनुसूचित जाति/जनजाति के सही मायने में वंचितों को आरक्षण दिया जाये। जस्टिस गवई की बात पर अपने रिमार्क देते हुए जस्टिस विक्रम नाथ, जस्टिस पंकज मिथल और जस्टिस एससी शर्मा ने सहमति जताई है। वहीं, पीठ में शामिल जस्टिस बेला त्रिवेदी ने असहमति जताई। जस्टिस चंद्रचूढ़ और जस्टिस मनोज मिश्रा ने मौन सहमति दी। असल में जो फैसला सुप्रीम कोर्ट ने आज दिया है। उस फैसले को लोकसभा व राज्यसभा में बहस के बाद वहां से आना चाहिए था। इस फैसले को आप सही मानते हैं या गलत? अपनी राय दें।
